1. Conditions Relating to the Sale of Products to You
This section deals with conditions relating to the sale of products by OfficeXpress Europe Limited to you.
2. The Contract
When you place an order to purchase a product from OfficeXpress Europe Limited, you will receive an e-mail from Kyocera Mita (UK) Limited confirming receipt of your order and containing the details of your order. Please note that this does not mean that your order has been accepted. Your order represents an offer to OfficeXpress Europe Limited to purchase a product which may be accepted by OfficeXpress Europe Limited when you receive e-mail confirmation that they've dispatched that product to you (the "Dispatch Confirmation e-mail"). The contract between us will be complete at the time the Dispatch Confirmation e-mail is sent to you. Any products on the same order which have not been confirmed in a Dispatch Confirmation e-mail to have been dispatched do not form part of that contract.
Your personal data will be passed on to Kyocera Mita (UK) Limited and they shall make use of your personal data in relation to the sale of the product and in relation to any activities determined by them which are unrelated to the sale of the product. If you do not wish to be contacted by Kyocera Mita (UK) Ltd in relation to any activity not related to the sale of the products then please use the ‘opt-out’ option before submitting your order.
3. Return of a Damaged, Defective or Incorrect Item
This page explains what to do if you've received a damaged, defective or incorrect item from the Kyocera Mita (UK) Limited. This returns policy does not affect your statutory rights.
Our Customer Care Department will guide you through our Returns Policy and provide you with a RMA number.
If the item was damaged in transit
• If you take delivery of a Kyocera Mita (UK) Limited Consumables Shop package and the contents have been damaged in transit, you can return the item(s) to us within 3 days providing that proof of delivery has been endorsed damaged.
Once the proof of delivery has been endorsed damaged, please contact our Customer Care Dept. who will issue a RMA number. (Returns Number)
Call Customer Care on 01274 651870 or email at customer-care@officexpress.co.uk and please state your order number, telephone number and your enquiry.
If damaged, we will replace like for like free of charge, if an alternative product was required, we will need to process a new order for the goods that are required and to take a new payment.
If the item is defective
• You have the right to return a faulty item(s) within a reasonable period 30 days. Please keep all the warranty information that accompanies your item as this may be needed should there be a fault. If you choose to return the item to us, please notify our Customer Care Department by email at customer-care@officexpress.co.uk
If we sent you an item you did not order (an "incorrect" item)
• As soon as you find out we've sent you an incorrect item notify our Customer Care Department within 3 days by email at customer-care@officexpress.co.uk and please state your order number, contact telephone number and your enquiry.
We will raise a RMA number and book a City Link Collection to pickup up the incorrect item(s) to be returned back to us for a refund.
Please note: Incorrect items must be returned unopened and in resalable condition.
If you want us to replace the item, you will need to place a new order and take a new payment.
Cooling-off period
• By law, customers in the European Union also have the right to withdraw from the purchase of an item within 7 working days of the day after the date the item is delivered. This applies to all of our products.
• To cancel your purchase within the 7 working day cooling-off period, please notify our Customer Care Department by email at customer-care@officexpress.co.uk. Please state your order number, contact telephone and giving the reason for the return as "I don't require it anymore". Our Customer Care Department will raise a RMA number and you will need to return your order back for a refund to the following address:

Items returned during the cooling-off period must be returned unopened and in resalable condition and must be received within 7 working days of the day after the date that the item was delivered to you.
• For your protection, we recommend that you use a recorded-delivery service if we happy to return the items.
• Please note that you will be responsible for the costs of returning the items to us unless we delivered the item to you in error, or if the item is damaged or defective.
Our Customer Care Department will arrange collection via city link for any endorsed with an authorised RMA number unless otherwise advised. Please package the relevant item(s) securely with the RMA number given on the outer box
We can accept returns if you deliver them to us by hand providing that you have been given a RMA number and is written on the outer of the packaging.
Note: in the event of OfficeXpress Europe Limited sending you a replacement for a damaged, defective or incorrect item, you must return the original item to OfficeXpress Europe Limited within 30 days of our e-mail confirming the issue of the replacement item. Provided you return this item to us within the 30 days, you will have nothing more to pay. If you do not return the original item to us by the end of the 30 day period, we reserve the right to charge an amount equal to the price of your original order to the payment card you used for the order.
4. Risk and Title
The products will be at your risk from the time of delivery.
Ownership of the products will only pass to you when OfficeXpress Europe Limited receive full payment of all sums due in respect of the products, including delivery charges.
5. Pricing and availability
OfficeXpress Europe Limited list available products sold by OfficeXpress Europe Limited on the website, including each the product information pages. OfficeXpress Europe Limited cannot be more specific about availability. They always endeavor to maintain accurate stock records, however, these are occasionally subject to error. Please note that product availability estimates are just that. They are not guaranteed and should not be relied upon as such. When goods are in stock you will receive a Dispatch Confirmation e-mail.Despite OfficeXpress Europe Limited’s efforts, a small number of the products in their catalogue may be mispriced. Rest assured, however, that they verify prices as part of their dispatch procedures. If a product's correct price is lower than their stated price, OfficeXpress Europe Limited charge the lower amount and send you the product. If a product's correct price is higher than OfficeXpress Europe Limited’s stated price, they will, at their discretion, either contact you for instructions before dispatch or cancel your order and notify you of such cancellation.All prices are exclusive of VAT unless stated otherwise. Payment shall be made to Cybersource a third party instructed to take payments on behalf of OfficeXpress Europe Limited.
6. Children
OfficeXpress Europe Limited do not sell products for purchase by children. By placing an order through our website you warrant that you are at least 18 years of age. If you are under 18, you may use the OfficeXpress Europe Limited facilities only with the involvement of a parent or guardian.
7. Electronic communications
When you visit the OfficeXpress Europe Limited online shop or send e-mails to us, you are communicating with us electronically. We communicate with you by e-mail or by posting notices on the website. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This condition does not affect your statutory rights.
8. Losses
OfficeXpress Europe Limited will be responsible for any losses you suffer as a result of us breaching these conditions if the losses were reasonably foreseeable to both you and us when you commenced using the website, or a contract for the sale of goods by us to you was formed. We will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss that is not reasonably foreseeable to both you and us when you commenced using the website or when a contract for the sale of goods by us to you was formed. OfficeXpress Europe Limited does not limit in any way their liability by law for death or personal injury caused from their negligence or breach of duty or caused by their gross negligence or wilful misconduct.
9. Alteration of Service or Amendments to the Conditions
OfficeXpress Europe Limited reserve the right to make changes to our website, policies, and these Conditions of Use & Sale at any time. You will be subject to the policies and Conditions of Conditions of Use & Sale in force at the time that you use the website or that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.
10. Events beyond our reasonable control
OfficeXpress Europe Limited will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.
11. Transfer of Rights and Obligations
The contract between you and OfficeXpress Europe Limited is binding on you and OfficeXpress Europe Limited and its respective successors and assigns.
You may not transfer, assign, charge or otherwise dispose of a contract or any of your rights or obligations arising under it without the prior written consent of OfficeXpress Europe Limited.
OfficeXpress Europe Limited may transfer, assign, charge, sub-contract or otherwise dispose of a contract or any of its rights or obligations arising under it at any time during the term of the contract.
12. Severability
If any of these terms and conditions are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term or condition will to that extent be severed from the remaining terms and conditions which will continue to be valid to the fullest extent permitted by law.
13. Waiver
If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.
14. Entire Agreement
These terms and conditions any any document expressly referred to in them represent the entire agreement between you and OfficeXpress Europe Limited in relation to the subject matter of any contract and supersede any prior agreement, understanding or arrangement between you and OfficeXpress Europe Limited whether oral or in writing.
15. Variation
OfficeXpress Europe Limited has the right to revise and amend these terms and conditions from time to time.
16. Governing law and jurisdiction
These conditions are governed by and construed in accordance with English law. You agree, as we do, to submit to the non-exclusive jurisdiction of English law.
