- These terms & conditions govern the Kyocera Mita Money Back Guarantee ("the Guarantee") which applies when you buy a new Kyocera Mita FS-2000D, FS-3900DN, FS-4000DN, FS-6950DN, FS-9120DN, FS-9530DN, FS-C8008N, FS-C5020N, FS-C5030N and FS-C8100DN printer ("the New Printer") from an authorised Kyocera Mita UK Reseller for your own or your company's use to replace an existing workgroup printer ("the Old Printer") which is another manufacturer's desktop laser printer with a print speed in the range of 10-50 pages per minute.
- When buying the New Printer you must supply to us the receipted invoice for your purchase of the New Printer and a status page from the Old Printer in order to register for the Guarantee. We will retain this information. You may then lodge a guarantee claim for an FS-2000D, FS-3900DN, FS-4000DN, FS-6950DN, FS-8008N, FS-C5020N, FS-C5030N and FS-C8100DN after you have printed 50,000 pages on the New Printer but before you have printed 300,000 pages, and for an FS-9120DN or FS-9530DN after you have printed 50,000 pages on the new printer but before you have printed 3,000,000 pages. Claims must be lodged within three years from the date of your purchase of your New Printer.
- At the time of a claim under this Guarantee, we will calculate the current Consumables Cost per page for the Old Printer and the New Printer by taking the price of each consumable item and dividing it by the relevant manufacturer's published yield(s) at 5% print density. We will obtain current Consumables prices by taking the average of three resellers' prices for such consumables, as advertised by them in the then current issue of "Computer Shopper" magazine or other authoritative source.
- Consumables" means TK-310 and MK-310 maintenance kit for the FS-2000D, TK-320 and MK-320 for the FS-3900DN, TK-330 and MK-320 for the FS-4000DN, TK-440 and MK-440 for the FS-6950DN, TK-70 toner kit plus MK-702 for the FS-9120DN, TK-710 and MK-710 for the FS-9530DN, TK-510K/C/M/Y toner kits, MK-510/MK-520 maintenance kit for the FS-C5020N/FS-C5030N, TK-820K/C/M/Y toner kits, MK-820A/B maintenance kits for the FS-C8100DN, and, for the Old Printer, toner cartridge pus the drum, developer, oil filter or fuser unit (as appropriate) where their replacement is necessary within the page count at which the Guarantee claim is registered (according to its manufacturer's published data.)
- The difference in Consumables Costs between the New Printer and the Old Printer will be calculated by taking the actual page count at the time of your claim multiplied by the Consumables Cost per page for each printer by applying the formula in Clause 3 above. Where the Consumables Cost of the New Printer exceeds the Consumables Cost of your Old Printer, we will reimburse you the Price of your New Printer. Please note that for colour printers, the guarantee shall not apply for mono consumables where black toner is supplied free of charge, however colour consumables on such printers will qualify.
- The New Printer is yours to keep even if, under this guarantee, we repay you the Price you paid for it. The Price excludes VAT if the purchaser was VAT registered, otherwise it includes VAT. The Price, as so defined, is the total extent of our liability in respect of any one New Printer.
We will not accept any claim under this Guarantee where you have not paid in full for the New Printer or have breached any terms of the relevant Kyocera Mita or ECOSYS warranty in respect of the New Printer (including but not limited to operating the New Printer outside its published duty cycle or using other than original Kyocera Mita Consumables in the New Printer). - By providing the information required at clause 2 above you agree to be bound by the terms & conditions of the Guarantee. This Guarantee is subject to English law and the English courts shall have exclusive jurisdiction.
- Force Majeure. We shall not be liable for any failure to meet our obligations under this guarantee resulting from causes beyond our reasonable control including, but not limited to, fire, strikes, insurrection or riot, embargoes, delays in transportation and ability to obtain supplies, government requirements or regulation.
- Terms and conditions are subject to change without notice. We may end the Guarantee scheme at any time so that it ceases to apply to further sales of New Printers. In the event of a dispute the decision of Kyocera Mita is final.
